1. Introduction

These Terms of Service ("Terms") govern your use of The Journal Claw ("Service"), operated by dezent digital GmbH, Baden 5400, Switzerland (UID: CHE-405.267.191) ("we", "us", "our").

By creating an account or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.

2. Service Description

The Journal Claw is an AI-powered medical research digest platform. We monitor public research databases (PubMed, OpenAlex, medRxiv) for newly published papers and use artificial intelligence to generate summaries, key findings, and relevance scores.

The Service is designed to help healthcare professionals and researchers stay current with medical literature. It is not a medical device, not clinical decision support software, and not a substitute for reading the original publications.

5. Account Terms

To use the Service, you must create an account using a valid email address. Authentication is handled via magic link (passwordless email login) through Supabase Auth.

• You may only maintain one account per person.
• You are responsible for maintaining the security of your email account, as it controls access to the Service.
• You must be at least 16 years old to use the Service.
• You must provide accurate information when creating your account.

6. Subscription and Billing

The Service offers Free and Pro subscription plans. Payment for paid plans is processed by Stripe, Inc.

• Paid subscriptions are billed monthly in advance on the calendar date of your initial subscription.
• You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period.
• We do not provide pro-rata refunds for partial billing periods.
• Prices may change with 30 days' notice. Continued use after a price change constitutes acceptance.
• We reserve the right to modify or discontinue the Free plan at any time with 30 days' notice.

7. Acceptable Use

You agree not to:

• Use the Service for any purpose that violates applicable law.
• Attempt to access, scrape, or extract data from the Service via automated means beyond normal use.
• Redistribute AI-generated summaries at scale without attribution.
• Impersonate another person or misrepresent your affiliation.
• Interfere with the Service's infrastructure or security.

8. Intellectual Property

Original research papers and their metadata belong to their respective publishers and authors. The Journal Claw accesses publicly available bibliographic data and abstracts from PubMed, OpenAlex, and medRxiv.

AI-generated summaries are derivative works. The Service software, design, and branding are the property of dezent digital GmbH. You may use AI-generated summaries for your personal and professional reference.

9. Limitation of Liability

To the maximum extent permitted by Swiss law (Art. 97 ff. OR):

• The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied.
• We are not liable for any damages arising from your reliance on AI-generated content, including but not limited to clinical decisions.
• Our total liability for any claims related to the Service is limited to the amount you paid us in the 12 months preceding the claim.
• We are not liable for indirect, incidental, special, consequential, or punitive damages.

10. Termination

• You may delete your account at any time through the Settings page. Upon deletion, we will remove your personal data in accordance with our Privacy Policy.
• We may suspend or terminate your account if you violate these Terms or engage in abusive behavior.
• Upon termination, your right to use the Service ceases immediately. Any outstanding subscription fees remain due.

11. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes at least 30 days in advance via the email address associated with your account. Continued use of the Service after the effective date of changes constitutes acceptance of the revised Terms.

12. Governing Law and Jurisdiction

These Terms are governed by Swiss law (Swiss Code of Obligations and Swiss Civil Code). Any disputes arising from or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Baden, Canton of Aargau, Switzerland.
